Prior to 2016, the song was under copyright, and Warner/Chappell Music, Inc. claimed ownership and exclusive rights to the song. This meant that anyone who wanted to use the song in public, such as in movies, TV shows, commercials, or live performances, had to obtain a license from Warner/Chappell and pay royalties. In 2015, a federal judge ruled that Warner/Chappell’s copyright claim was invalid, and the song’s melody and lyrics were in the public domain. However, the court’s decision was appealed, and it wasn’t until February 2016 that a settlement was reached, requiring Warner/Chappell to pay back $14 million in licensing fees to those who had paid for the song’s use in the past. 1
